General Statement 

 

At Trusted Hands Care Group (“Trusted Hands” or the “Group”), we take privacy with the utmost seriousness and are currently and constantly ensuring that all our records and processes fully meet the data protection standards introduced by the UK General Data Protection Regulation (UK GDPR) and the Data Use and Access Act 2025 (DUAA). 

 

All of the Group’s care homes are registered as data processors with the Information Commissioner’s Office (ICO).

 

What type of information do we have

 

Due to the nature of the service we provide, we categorise the categories of information that we collect, hold and may share (if needed), including:

 

Personal information (name, address, date of birth, details of next of kin, social worker and any other professional associated with our service users).

Characteristics (ethnicity, language, nationality, country of birth, etc.)

 

We receive the information from Local Authorities, families of a loved one who can no longer stay at home, and the family require assistance.

 

Employees will need to provide the necessary information as requested by the HR team.

Suppliers will provide us with information required to complete our suppliers register to provide the services needed to protect and provide for our service users and staff.

 

Why do we have the information?

 

Trusted Hands Care Group require the information to provide the specific services required for each service user, as all are different. The information is used and shared with the Local Authorities for funding, as some service users are entitled to.

HR requirements for our staff, whereby we must collect information as it is a UK legal requirement. 

 

The Lawful Basis on Which We Use This Information

 

We collect and use information under the following lawful bases established by the UK GDPR and the DUAA 2025:

 

• Legitimate interests: the processing involves using your data in ways one would reasonably expect and which have a minimal privacy impact.

 

• Consent: the individual has given us clear consent for us to process their personal data for a specific purpose.

 

• Vital interests: the processing of our data is necessary to protect someone’s life.

 

• Legal obligation: the processing of our service users' data is necessary for you to comply with UK law (not including contractual obligations).

 

• Contract: the processing is necessary for the contract we have with the individual, or because they have asked us to take specific steps before entering into a contract.

 

• Legal obligation: when the processing is necessary for us to comply with the law (submitting data to Government Departments, for example).

 

Who Do We Share Information With?

 

As part of the service we provide, we routinely share information with:

• local authorities 

• suppliers and contractors 

• government departments

• other care homes/services within the Group 

 

In the event of a legal issue or emergency situation, it may be necessary to share certain information to protect an individual's life or to comply with court orders.

 

Why We Share Information

 

We share the information due to the service we provide, as we are governed by the CQC, whereby they carry out its periodic visits. This process is mandatory; therefore, our data must be stored securely, accurately, and kept up to date.

 

We prioritise the privacy of our service users and do not disclose any information to third parties without their explicit consent. However, consent may be granted by a legal representative or guardian, or disclosure may be required by the UK Courts in accordance with our policies.

 

Regarding our staff, we are required to share certain data with official bodies (such as HMRC, Inland Revenue, NI Contributions or the Department for Work and Pensions (DWP) on a statutory basis.

 

 

Data Collection Requirements

 

To be granted access to any information we hold, organisations must comply with strict terms and conditions covering the confidentiality and handling of the data, security arrangements and retention and use of the data.

 

Trusted Hands Care Group do not keep data for any longer than necessary and does not allow its use for any purpose other than that for which it has been collected. Should new processes be introduced into the Group or innovative uses of the data the Group holds, all third parties will be informed when this occurs.

 

Your data protection rights

 

Under data protection law, you have rights, including:

 

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete any information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances. 

Your right to object to processing - You have the right to object to the processing of your personal data in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

 

You also have the right to:

object to the processing of personal data that is likely to cause, or is causing, damage or distress, prevent processing for direct marketing, object to decisions being taken by automated means and, in certain circumstances, have inaccurate personal data rectified, blocked, erased or destroyed.
